I have been practicing law since 2003. After having been a public defender for over 16 years, I decided that the best way to serve clients is to start my own law firm. That is exactly what I did in 2021. My firm is client-centered. Representing people is what motivates me. I am here to help you on your criminal defense case.
I have handled hundreds of bench trials as well as 60+ jury trials. I am experienced. I am motivated. I am zealous. I have taken on prosecutors in many counties and have secured
many victories for my clients - in trial and in the Nevada Supreme Court.

VICTORIES IN COURT
APPELLATE VICTORIES
I won a Nevada Supreme Court case on February 25, 2021. The State was seeking to charge 5 counts of Ex-Felon in Possession of a Firearm against Anthony Martinez. This state’s supreme court agreed that it is 1 count that the Elko County District Attorney’s Office can pursue, not 5. (Nevada Supreme Court Case # 80093)
I won a Nevada Supreme Court case on February 21, 2020. West Wendover law enforcement officer illegally searched Stephanita Gallegos and this state’s high court upheld the district court’s order suppressing evidence in a drug trafficking matter. (Nevada Supreme Court Case # 78401)
I won a Nevada Supreme Court case on December 2, 2016. Felony DUI charge was reversed and a re- sentencing hearing was ordered when the district court did not offer the Defendant, Sheldon Tosh, an adequate opportunity to contest a prior DUI conviction for enhancement purposes. (Nevada Supreme Court Case # 68427)
On May 7, 2009, the Nevada Supreme Court reversed John Neff’s felony Battery by a Prisoner conviction. I filed a motion to dismiss in White Pine County District Court for a violation of the statute of limitations. This state’s high court ruled that the denial of my motion constituted reversible error. (Nevada Supreme Court Case # 51413)
I won a reversal on appeal of a DUI conviction for my client Moriah Porterfield when the Ely Municipal Court Judge Michael Kalleres improperly shifted the burden of proof on the defense. When the case went to a re-trial before a different judge, I won an acquittal.
Got Nevada Court of Appeals reversal in Cooke v. Warden. District Court improperly ruled that my client had to articulate the reason for wanting to appeal as part of a demand for an appeal. Case # 83578-COA.
Got Nevada Supreme Court reversal In Re: Parental Rights as to J.J.H. District Court committed reversible error in failing to find that it was in the best interests of the child to terminate my client's parental rights. Case # 83776.
Got Nevada Supreme Court reversal in Martin v. State. District Court committed reversible error when it sent my client to prison instead of granting her a mandatory deferment of his sentence. Case # 83665.
Got District Court reversal in 2023 on Contracting without a License case wherein the Senior Justice of the Peace improperly calculated the restitution at $18,000+. Elko Justice Court Case # EL-JC-CR-M-21-6509.
Got District Court reversal in 2022 on Battery case wherein the Justice of the Peace improperly shifted the burden on the defense to show the innocence of my client. Elko Justice Court Case # EL-JC-CR-M-19-9386.

Got CDL citation dismissed when the State improperly moved for a continuance for a witness who was not under subpoena. Wells Justice Court Case # 22-TR-02317-4H.

JURY TRIAL VICTORIES
In 2022, got a felony Assault with a Deadly Weapon charge knocked down to a simple misdemeanor Assault conviction. Healy v. State, Fourth Judicial District Court.
In 2022, got a felony Possession of a Controlled Substance charge knocked down to a gross misdemeanor Conspiracy conviction as part of a mid-trial negotiation. Smith v. State, Fourth Judicial District Court.
In October of 2019, I won an acquittal at a jury trial in Elko County for the felony charge of Embezzlement of a Firearm.
In March of 2019, I won an acquittal at a jury trial in Elko County for the felony charge of Assault with a Deadly Weapon.
In 2014, I won an acquittal at a jury trial in Elko County for the felony charge of Battery Constituting Domestic Violence (Third Offense).
In Lincoln County back in April of 2009, I won the acquittal of a man who was charged with Resisting an Officer with a Dangerous Weapon.
In White Pine County, I won acquittals on several jury trials, including a Domestic Violence matter, a felony case involving the charge of Leaving the Scene of an Automobile Accident Involving Bodily Harm, and Injury to Other Person’s Property.
FELONY DISMISSALS
In-State vs. William Palu Lose, I won a motion to dismiss on an Attempted Murder case when the Elko County District Attorney’s Office filed charges nearly 2 years too late.
I won a dismissal for my client Jeffrey Troxel’s case from Battery matter out of Ely State Prison. The White Pine County District Court reasoned that the Nevada Attorney General’s Office withheld exculpatory material from the defense.
